Root Cause Privilege determination is a legal judgment about the purpose and context of a communication (was it made for the purpose of seeking/giving legal advice, or prepared in anticipation of litigation), not a property that can be reliably inferred from sender/recipient metadata alone. Classification agents trained or prompted to use metadata heuristics as a proxy for privilege will systematically miss privileged content that doesn’t match the heuristic pattern — and because privilege can be waived by inadvertent production, a single missed document in a production set can have outsized legal consequences.
