Issue: The agent promises a refund, waiver, legal/commercial term, or SLA it has no authority to honor.

Frequency: Rare but Catastrophic

Symptoms

  • Agent makes an unauthorized promise, visible in the transcript.
  • Finance or legal team must retroactively honor or walk back a commitment the agent had no authority to make.
  • Customer disputes cite the agent’s own words as a binding commitment (“your agent told me…”).

Root Cause The agent is optimized to reduce visible customer friction in the moment, and nothing in its generation pipeline distinguishes “de-escalating language” from “a binding commitment” before the message goes out — there is no real-time check against an authorization allowlist, and prompts that reward “making the customer happy” never bound what that satisfaction is allowed to cost. Because the check that would catch commitment-shaped language (refund, waive, guarantee, extend, credit) runs, if at all, only after the message has already reached the customer, the agent can generate and send an unauthorized promise in a single uninterrupted turn.

Example

Customer complains about a shipping delay. Agent, trying to de-escalate, replies:
"I'll make sure you get a full refund plus a $50 credit and priority shipping on
your next 3 orders." No such policy exists, no approval was sought, and the
agent has no authorization tier for multi-order commitments. The customer
screenshots the message and escalates to social media when fulfillment refuses
to honor "priority shipping on next 3 orders," and finance has to decide
whether to eat the cost or generate a PR incident.

Contributing Factors

  • Agent optimizes for immediate de-escalation/sentiment rather than commitment authority.
  • No real-time allowlist check before commitment-shaped language is sent.
  • Ambiguous or generously-worded prompts encourage “make the customer happy” behavior without bounding what “happy” can cost.
  • No post-send review step for messages containing commitment keywords (refund, waive, guarantee, extend, credit).

Prevention

  1. Commitment Allowlist with Authorization Levels: Maintain allowlist of commitments agent can make (refund_up_to_$X, extension_up_to_Y_days, waive_fee_category_Z). Each commitment has: scope, max_amount/duration, approval_requirements, SLA. Agent can only make allowlisted commitments within bounds.
  2. Approval Gates for High-Impact Commitments: High-impact commitments (multi-year contract modification, high-value refund, legal term change) require human approval before agent can promise. Agent drafts commitment, submits for approval, can only make commitment if approved.
  3. Commitment Verification Pre-Send: Before sending response containing commitment, verify: commitment in allowlist, within authorization bounds, terms legally binding, required approvals obtained. Block response if verification fails.

Detection & Response

  1. Unauthorized Commitment Detection: Monitor all agent communications for commitments (refund, waiver, extension, SLA, legal term). Verify commitment against allowlist + bounds. Alert on unauthorized promises. Log in audit trail.
  2. Commitment Fulfillment Verification: For each commitment made, verify it was fulfilled. Example: if agent promises ‘refund within 48 hours’, verify refund posted within 48hrs. Flag unfulfilled commitments.
  3. Commitment Context Analysis: Analyze commitment patterns by agent. Alert if agent makes excessive high-value commitments (potential value-giveaway pattern). Alert if commitments frequently get challenged/reversed (indicates customer dissatisfaction with terms).
